Terms and Conditions of Trade
All goods and services are supplied on the terms and conditions set out herein and no addition or variation to these terms and conditions will have any effect unless expressly agreed in writing by the Seller.

The EnzyCleanse treatment carries a limited 2-year reinspection and retreatment guarantee when entire property is treated on a single visit. The guarantee provides for the premises to be retreated (at XsporWA’s Discretion) with the EnzyCleanse up to but not exceeding the value of the initial treatment. The guarantee is transferable to the new homeowners in the event of a sale but excludes contamination that may be Introduced/reintroduced from other sources such as but not limited to new furniture, ongoing water contamination (existing or new leaks, moisture or condensation) or introduction/reintroduction of contamination from air-conditioning (including ducting), external sources e.g. building alterations.

The EnzyCleanse treatment requires property is to be dry (free from moisture), locked up and vacated for 12 hours post the treatment to allow the EnzyCleanse to work most effectively. Failure to do so will reduce the effectiveness of the treatment and void the reinspection and retreatment guarantee.

XsporWA will furnish all labour, materials, and equipment necessary to complete XsporWA supplied services only. This excludes Moving or Disassembly of Artwork, Valuables, Furniture and Fittings for EnzyCleanse or microSURE treatments, Remediation of the Building Structure and Property in relation to Leaks, Dampness (unless specified and accepted by XSPORWA in writing), Water Contamination, Staining/Marking of Surfaces, Painting, HVAC, Plumbing or Construction. It is the client’s sole responsibility to ensure all furniture is prepared for treatment.

XsporWA will take all necessary precautions to minimise ambient biological contaminants and inanimate allergens during the treatment.

XsporWA will not be responsible for regrowth following service due to the original cause not being addressed such as but not limited to water leaks, dampness, condensation, inadequate ventilation, lack of maintenance, movement or disassembly of furniture for treatment or movement of untreated furniture / treated furniture between premises etc.

XsporWA does not accept responsibility for any pre-existing health conditions that are a result of the presence of environmental problems related to mould, mildew, pets, or pests before our service is provided nor accept any liability for health conditions or reactions caused by hypersensitivity or irritations that may be experienced from the use of the products within the site.

XsporWA provides the EnzyCleanse and microSURE treatments under the understanding that as a natural solution’s, the products do not contain hazardous substances (refer Materials Data Sheet or MDS on the XsporWA Website). As such the treatments are provided with understanding that the Company cannot be held liable for any costs associated with any allergenic reactions that may be experienced.

Where pre and post Air Sampling has been contracted and paid for, we will collect the post air samples approximately one (1) week after completion of the job and when payment has been received.

In the event of a dispute, the client will be responsible for any associated costs of testing and/or mediation. In the additional samples are required, these will be collected and analysed by an independent laboratory agreed to by both parties.

Where XsporWA requires equipment to remain on site for drying or equipment is supplied as rental. It is the customer’s responsibility for the equipment security. Any damage to or loss of equipment will result in repair or replacement of the affected property at the clients expense. XsporWA accepts no responsibility for losses experienced by the client for faults or damage to the clients premises through defective wiring or circuits in the home or fire events in the event that equipment is moved from its configured location or covered whilst operating.

XsporWA requires the quotation to be accepted (and if required for payment, a purchase order to be provided) prior to works commencing. All Services are provided are strictly Cash on Delivery (COD) unless confirmed in writing by XsporWA. Payment of any outstanding account remains the responsibility of the individual accepting the quotation (unless a purchase order is provided by the organisation contracting services). XsporWA will not accept reassignment of outstanding amounts to a third party unless confirmed in writing by the third party and XsporWA prior to works being completed. As the company offers several payment options, we require outstanding amounts to be settled on the date of completion of treatment or provision of service or within 24 hours following completion of works. If the outstanding account is not settled within the designated terms (unless revised terms are agreed to in writing by XsporWA), a late payment fee will apply. This additional charge will be calculated at 1.5% per week on the outstanding balance and be compounding for 30 days. Following that time at XsporWA discretion, debt recovery action may be initiated, and the cost of recovery (including mediation and legal action) will be added to the amount outstanding.

These General Terms and Conditions of Quotation and Sale shall constitute the entire agreement between the Seller and the Customer, and no terms, conditions, obligations or other provisions of any nature not contained in these General Terms and Conditions of Quotation and Sale shall be of any effect. For the avoidance of doubt, these General Terms and Conditions of Quotation and Sale shall apply in all circumstances, including where the Customer validly accept this quotation or where the Customer and the Seller otherwise proceed with carrying out work under the Order, whether or not the Customer, at any time and by any means, purports to impose its own terms and conditions.

These General Terms and Conditions of Quotation and Sale are governed by, and are to be construed in accordance with, the laws of Australia and the parties submit to the non-exclusive jurisdiction of the courts of Western Australia and any court hearing appeals from those courts.
